Privacy Policy

Fayrely™ Services respects your privacy and is committed to protecting your personal information. We collect only the information needed to provide notary, apostille, document support, and inspection services, respond to inquiries, schedule appointments, and comply with legal and regulatory requirements.

Information we may collect includes your name, contact details, document-related information you choose to share, and limited transaction details for billing and recordkeeping. We do not sell your personal information.

Information is stored securely and accessed only for legitimate business purposes, such as scheduling, communication, invoicing, and required recordkeeping. When we use third‑party service providers (such as payment processors or secure video platforms), they are expected to maintain comparable safeguards.

You may contact us to ask how your information is used or to request corrections where appropriate. We retain records only as long as necessary for legal, regulatory, and business purposes.

Terms of Service – Professional Notary, Mobile & Remote Online Notary Services (Illinois)

These Terms of Service govern all professional notary, mobile notary, electronic notary, and remote online notary (RON) services provided by Fayrely Services within the State of Illinois.

1. ACCEPTANCE OF TERMS
By accessing, booking, scheduling, paying for, or receiving services, the Client agrees to be legally bound by these Terms of Service (“Agreement”). If Client does not agree, services will not be provided. This Agreement applies to all current and future services unless replaced by a written agreement signed by both parties.

2. LEGAL STATUS & DISCLAIMER OF LEGAL SERVICES
Service Provider is commissioned as an Illinois Notary Public and may offer administrative support services.

“I AM NOT AN ATTORNEY LICENSED TO PRACTICE LAW IN ILLINOIS. I AM NOT PERMITTED TO DRAFT LEGAL DOCUMENTS OR RECORDS, AND I CANNOT GIVE LEGAL ADVICE OR PROVIDE LEGAL REPRESENTATION ON ANY MATTER. I DO NOT ACCEPT OR CHARGE FEES FOR ANY ACTIVITIES THAT CONSTITUTE THE PRACTICE OF LAW.”

Client acknowledges that no legal advice, legal interpretation, legal drafting, or representation is provided.

3. LIMITED SCOPE OF SERVICES
Services are strictly limited to:
• Performing lawful notarial acts
• Administrative coordination services
• Observational field inspections (non-diagnostic)
• Authorized agent retrieval services
• Technology-enabled notarization

Service Provider does not guarantee document validity, enforceability, acceptance, or legal sufficiency.

4. CLIENT WARRANTIES & REPRESENTATIONS
Client represents and warrants that:
• All information provided is accurate and truthful
• All documents are lawful and complete
• Signers are acting voluntarily and have legal capacity
• Documents do not contain fraudulent or unlawful content
• Client has authority to request services
• Receiving jurisdictions accept the requested service (including RON)

Client assumes full responsibility for document content, legality, and use.

5. MANDATORY REFUSAL & TERMINATION RIGHTS
Service Provider may refuse or terminate services immediately if identity verification fails, valid ID is not presented, coercion is suspected, or activity constitutes unauthorized practice of law. Mandatory refusal will occur when required by law.

6. FEES, DEPOSITS & PAYMENT
All pricing is disclosed prior to confirmation. Illinois statutory fees ($5-$25 per act) plus administrative and technology fees apply. Deposits are generally non-refundable unless stated by notary and reserve service time. Payment is due prior to service. Credit and debit cards will be charged for services rendered and any other applicable fees ( i.e late fees, cancelation fees, no-show)

7. NO WARRANTIES
All services are provided “AS IS.” Service Provider makes no warranties regarding merchantability, fitness for purpose, or acceptance by foreign governments or courts. Client assumes all risk associated with document use.

8. LIMITATION OF LIABILITY
Total aggregate liability shall not exceed fees paid for the specific service. Service Provider is not liable for indirect, consequential, or incidental damages, including embassy rejection or courier delays.

9. INDEMNIFICATION & HOLD HARMLESS
Client agrees to indemnify Service Provider against all claims arising from breach of agreement, fraud, misrepresentation, or misuse of notarized documents.

10. ASSUMPTION OF RISK
Client acknowledges that notarization does not validate document legality. Field inspections are observational only. Technology risks and foreign government acceptance are assumed by Client.

11. FIELD INSPECTION LIMITATIONS
Inspections are visual, non-invasive, and observational. No valuation or legal conclusion is provided. Access safety risks may result in partial reports.

12. APOSTILLE & INTERNATIONAL DISCLAIMER
Service Provider acts as administrative coordinator. No guarantee of embassy or foreign consular processing timelines or acceptance is made.

13. VITAL RECORD RETRIEVAL LIMITATIONS
Service Provider acts only as an authorized agent. No certification authority exists beyond the issuing agency. Client must provide lawful authorization.

14. PRIVACY & RECORD RETENTION
RON recordings and notarial journals are retained per Illinois law. Liability for cybersecurity breaches is limited to reasonable control measures.

15. FORCE MAJEURE
Service Provider is not liable for delays caused by government closures, platform outages, natural disasters, or other events beyond reasonable control.

16. DISPUTE RESOLUTION
This Agreement is governed by Illinois law. Venue is exclusively in Illinois, and claims must be filed within one (1) year of service date.

17. SEVERABILITY, 18. WAIVER & 19. ENTIRE AGREEMENT
These Terms constitute the entire agreement. Unenforceable provisions are severed, and failure to enforce any provision is not a waiver.

20. ACKNOWLEDGMENT
By booking services, Client affirms they have read these Terms, understand liability limitations, accept risk allocation, and agree to all payment and refusal terms.
